“Reference is made to your e-mail correspondence dated and received at this office on April 29, 2020, requesting copies of all documents for NYS Police calls to 13590 Duanesburg Road in Delanson, New York, from January 1, 2017 to April 29, 2020, as well as copies of all documents, reports and information pertaining to a house explosion and fire at the aforementioned address on March 8, 2020, pursuant to the requirements of Article 6 of the Public Officers Law (Freedom of Information Law).
Please be advised that copies of two (2) Incident Reports located concerning the above will be forwarded to you upon receipt of a check or money order in the amount of $30.00, pursuant to the statutory fee of $15.00 per report (Public Officers Law 66-a(2)). The check or money order should be made payable to the “Superintendent of State Police” and forwarded directly to Central Records at the address listed below. Redactions will be made to any statutorily exempt portions in accordance with the Freedom of Information Law.
The remaining records located responsive to your request are records which, if disclosed, would constitute an unwarranted invasion of the personal privacy of those concerned (Public Officers Law § 87(2)(b)). This portion of your request is therefore denied. A search of our files failed to locate any records regarding a house explosion on March 8, 2020. Pursuant to Public Officers Law § 89(4)(a), any person denied access to a record may appeal that determination within thirty days. Any appeals must be in writing and mailed to the Records Appeal Officer, Administration, at the below address.”
