“The U.S. Supreme Court on Thursday unanimously overturned the 2018 “Buffalo Billion” bid-rigging convictions of SUNY Polytechnic Institute founder Alain Kaloyeros and three upstate businessmen while also reversing the fraud-related conviction earlier that year of Joseph Percoco, the once powerful top aide to former Gov. Andrew M. Cuomo.
Kaloyeros, who left war-torn Lebanon and relocated to the Capital Region where he led a nanotechnology revolution in New York state, was convicted along with his co-defendants under a theory of wire fraud that “criminalizes traditionally civil matters and federalizes traditionally state matters” and is “invalid under the federal fraud statute,” Associate Justice Clarence Thomas stated in authoring the 9-0 ruling.”
