How to: Report a Property Maintenance Violation

Some municipalities may have a regulation that a property cannot obtain a permit if there are outstanding violations filed on the property.

Submit a Freedom of Information request for the address and tax id number of the the parcel in question to the municipality.

If you believe that the property is in violations then take photos documenting your concerns and submit a letter of concern during privilege of the floor at the next town board and planning board meeting. Provide the clerk with a copy of your letter and photos. Keep a copy of your letter and photos for future reference.

Dear SUPERVISOR NAME and the TOWN BOARD,

I would like to report STREET ADDRESS tax parcel TAX ID NUMBER for Property Maintenance Code (PMC) violations.

Please see attached images from Google Maps DATE as well as images from DATE taken from LOCATION WHERE YOU TOOK PHOTOS FROM which document many violations including but not limited to:

THE BELOW TEXT IS SPECIFIC FOR THE TOWN OF DUANESBURG. PLEASE CONTACT YOUR TOWN FOR RELEVANT ZONING ORDINANCE AND PROPERTY MAINTENANCE VIOLATION REGULATION TEXT.

Sanitation. All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The occupant shall keep that part of the exterior property which such occupant occupies or controls in a clean and sanitary condition.

Weeds. All premises and immediate exterior property shall be maintained free from weeds or plant growth in excess of 10 inches (254 mm). All noxious weeds shall be prohibited. Weeds shall be de-fined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens.

General. The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare.

Protective treatment. All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches, trim, balconies, decks and fences shall be maintained in good condition. Exterior wood surfaces, other than decay resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints as well as those between the building envelope and the perimeter of windows, doors, and skylights shall be maintained weather resistant and water tight. All metal surfaces subject to rust or corrosion shall be coated to inhibit such rust and corrosion and all surfaces with rust or corrosion shall be stabilized and coated to inhibit future rust and corrosion. Oxidation stains shall be removed from exterior surfaces. Surfaces de-signed for stabilization by oxidation are exempt from this requirement.

Window, skylight and door frames. Every window, sky-light, door and frame shall be kept in sound condition, good repair and weather tight. PMC 304.13.1 Glazing. All glazing materials shall be maintained free from cracks and holes.

This property has not been inhabited for HAW MANY YEARS years and the owner has allowed it to fall into disrepair and neglect.

I request that the town code enforcement officer perform a property visit and if appropriate contact the property owner to bring the property in compliance with our town’s zoning ordinance.
